uAvionix Secures FAA Approval for BVLOS operations in North Dakota

uAvionix has announced that it has received authorization from the Federal Aviation Governance (FAA) to conduct Beyond Visual Line of Sight (BVLOS) operations using its Uncrewed Aircraft System (UAS) in North Dakota. This approval leverages the Vantis Command and Control (C2) and Detect and Avoid (DAA) network, allowing the company to bypass certain regulations, specifically 14 CFR 91.113(b) and 14 CFR 61.3(a)(1). This exemption enables the use of the Vantis network to comply with right-of-way rules and eliminates the necessity for operators to possess a pilot’s license under Part 61.

Recently, the FAA sought public feedback on four exemption requests from various UAS operators, each representing diverse applications.The goal is to establish a framework that could lead to formal BVLOS regulations, thereby advancing the industry in the absence of established guidelines.

Infrastructure approval: A Unique Case

The exemption granted to uAvionix stands out from the other requests as it pertains specifically to infrastructure approval. The vantis network, which facilitates C2 and DAA capabilities, was developed by a collaborative team that includes the Northern Plains UAS Test Site, Thales, uAvionix, and other partners.uAvionix plays a dual role as both the UAS manufacturer and operator, contributing essential C2 and DAA technologies to the initiative. The overarching aim of Vantis is to create and implement a commercially viable UAS BVLOS flight system across North Dakota and perhaps other states,fostering growth within the UAS sector.

Significance of the Exemption

This exemption marks a pivotal achievement, as it allows for repeatable operations, unlike standard waivers that are typically one-time approvals. The exemption, which is a form of rulemaking, can serve as a reference for future approvals, streamlining the process considerably. Importantly, this exemption is not limited to the initial applicant; it benefits the entire industry. With this approval, BVLOS operations are set to expand, particularly in North Dakota, where the established infrastructure can be utilized for consistent operations. Similar frameworks could also be adapted for use in other regions.
